Our client’s motorcycle hit a car which made a left turn in front of him in Port Washington, Long Island. Before the trial, we obtained a court order from the New York State Supreme Court in Queens, ruling that the driver was 100% at fault for causing the accident.

Our client had some short-term memory loss after a concussion and a CT scan at the hospital, which indicated he had a small brain bleed.

The insurance company never made a settlement offer until 7 months before the trial. They requested a mediation to discuss the possible settlement of the case. At the mediation, we demanded $1,500,000. Even after watching the video below, the insurance company offered to settle his case for only $150,000! We declined to negotiate further and walked out of the mediation.

When an insurance company makes a low offer, it makes the decision to go to trial easy.

The defendant’s doctor testified that our client’s memory loss was caused by smoking marijuana since he was a teenager and the heart medication he was taking.

The defense lawyer asked the jury to give our client $100,000 for his broken ribs (2nd video below) and nothing for his brain injury. The jury gave our client $1,000,000.

We paid a company to convert a 2-D black-and-white CT scan (which looks like many still X-ray images) into this 3-D color video which was shown at trial so our client’s doctor could explain to the jury how our client’s brain bleed caused damage to his brain.

Broken Ribs

This video, also made from a 2-D black-and-white CT scan, was shown at trial to demonstrate the seriousness and pain associated with our client’s broken ribs. The defense attorney asked the jury to give our client $100,000 for his broken ribs.

Fractured Femur (Thighbone)

Published in New York Jury Verdict Review & Analysis and listed by TopVerdict as the 48th largest motor vehicle verdict in New York State for 2017.

Our client, an off-duty motorcycle police officer, broke his leg when a car made a left turn in front of him, and his motorcycle struck the car’s rear bumper.

He returned to full duty without restrictions 6 months after the accident, and the insurance company offered $50,000 to settle the case.

Before the trial, the New York State Supreme Court in Suffolk County ruled that the driver of the car was 100% at fault for causing the accident.

The insurance company paid the entire jury verdict of $425,000.

Torn Meniscus (Knee injury)

Believed to be the largest jury verdict on record in Nassau County for a meniscus tear, this verdict was published in New York Jury Verdict Review & Analysis and is listed by TopVerdict as the 43rd largest motor vehicle verdict in New York State for 2017.

Our client had arthroscopic surgery to repair a torn meniscus in his knee after his motorcycle struck a car that turned left in front of him.

The driver had $300,000 insurance coverage, but his insurance company offered only $10,000 to settle.

The defendant’s insurance company hired two orthopedic surgeons and a radiologist to testify that the meniscus was not torn and the surgery was unnecessary.

The jury compensated our client with a verdict of $425,000.
